These Terms govern your use of the Tradefend website, terminal and connectors (the "Service"), operated by Tradefend LLC ("Tradefend", "we", "us"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
Tradefend is analytical software that reads trading-account state you connect and computes rule-compliance information against parameters published by proprietary trading firms or configured by you. The Service is not investment, financial, trading, tax or legal advice; not a broker, futures commission merchant, retail foreign-exchange dealer or exchange member; and does not direct or manage customer accounts. See our Risk Disclosure, which is part of these Terms.
You receive a Terminal ID (an "FX-" number) at signup. The ID identifies you; your password is the secret — keep it confidential. You are responsible for activity under your account. Connector API keys you create are scoped read-only; arming Breach Guard additionally authorizes position-closing (flatten) instructions as described in Section 4. For hosted connections you may submit your platform sign-in through the sealed connect flow (encrypted in your browser; used solely to operate your connection and deleted on disconnect) or approve access via the platform's own OAuth page (e.g. cTrader) — both revocable at any time. You may revoke keys at any time from your trading platform or from your Tradefend profile.
Breach Guard is optional and disabled by default. If you arm it, you are issuing a standing instruction for Tradefend to attempt to submit position-closing orders (and cancel working orders) on the connected account when worst-case equity approaches thresholds you configured. Breach Guard is provided on a best-effort, "not held" basis — no guarantee of submission, execution, timing or price. Where our rules for your firm say that a close inside the firm's news window itself counts against the account, Breach Guard waits for that window to end before it submits, unless equity nears the firm's own limit first; the terminal says so on an account where this applies. You may disarm it at any time. You are responsible for confirming your firm permits automated trade management before arming.
You agree not to: share one subscription across multiple traders; probe, scrape or reverse-engineer the Service; resell Service output; or use the Service in violation of law or of your agreements with your firm or broker. We may suspend accounts that abuse the Service or its infrastructure.
Firm rules are third-party data that change without notice. We re-verify rule sets regularly and model conservative readings of ambiguous rules, but we do not warrant that rule data is complete, current or error-free. Your firm's own systems and decisions are authoritative. You remain solely responsible for compliance with your firm's rules.
The firms and account types the Service covers change as firms change what they sell and what they allow. When a firm stops selling an account type, it can no longer be added as a new account, but an account you have already added keeps working on the same rules for as long as the firm runs it. When a firm does not allow software like ours on an account type, we stop supporting that account type and show the reason in the app. We tell the subscribers affected by email when an account type they use changes or stops being supported. A change in which firms or account types the Service covers does not entitle you to a refund or a credit; Section 5 sets out the refunds we give.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY OR ERROR-FREE, THAT VERDICTS OR CALCULATIONS WILL MATCH YOUR FIRM'S DETERMINATIONS, OR THAT BREACH GUARD WILL PREVENT ANY RULE VIOLATION OR LOSS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR TRADING LOSSES, LOST PROFITS, LOST EVALUATION FEES, LOST FUNDED ACCOUNTS OR LOST PAYOUTS, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL AGGREGATE LIABILITY IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.
You may stop using the Service and cancel at any time. We may terminate or suspend access for breach of these Terms. Sections 2, 7, 8, 9 and 11 survive termination.
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in Texas.
We may update these Terms at any time. The date at the top of this page shows when they last changed. An update takes effect when it is posted here, and continued use of the Service after that constitutes acceptance.

Risk disclosure. Futures, foreign currency and options trading contains substantial risk and is not for every investor. An investor could potentially lose all or more than their initial investment. Risk capital is money that can be lost without jeopardizing one's financial security or lifestyle. Only risk capital should be used for trading, and only those with sufficient risk capital should consider trading. Past performance is not necessarily indicative of future results.
Hypothetical performance disclosure (CFTC Rule 4.41). Hypothetical performance results have many inherent limitations, some of which are described below. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown; in fact, there are frequently sharp differences between hypothetical performance results and the actual results subsequently achieved by any particular trading program. One of the limitations of hypothetical performance results is that they are generally prepared with the benefit of hindsight. In addition, hypothetical trading does not involve financial risk, and no hypothetical trading record can completely account for the impact of financial risk of actual trading. For example, the ability to withstand losses or to adhere to a particular trading program in spite of trading losses are material points which can also adversely affect actual trading results. There are numerous other factors related to the markets in general or to the implementation of any specific trading program which cannot be fully accounted for in the preparation of hypothetical performance results and all which can adversely affect trading results.
